Terms of sale

 

La Pèlerine defines its terms and conditions of sale (TOS) according to the specific features of its trips. Any purchase of a trip implies acceptance of these conditions. In the event of any contradiction between the TOS in the brochure and those on the www.lapelerine.com website (hereinafter, the "Site"), the latter shall prevail.

We inform you that the travel packages offered by La Pèlerine are considered, within the meaning of the regulations, as "packages", and that as such, you benefit in particular from the rights set out in article 13 below.

1/ OUR VOYAGE OFFREES

On our Site, we provide you with detailed information on the nature and specific features of each trip. In particular, you will be able to consult the programme day by day, practical information about the destination and all the information you need to make the trip (level of physical effort, minimum number of participants, etc.). A "Date and Price" section will give you an indication of the price of the trip on the date in question.

We would like to draw your attention to the fact that we offer trips that may require a greater or lesser degree of physical commitment. We therefore recommend that you carefully read the information relating to the level of physical commitment required to undertake the planned trip. It is up to each participant to determine, on the basis of the information provided, whether he or she has the necessary capabilities.

In case of doubt and before registering, we invite you to contact La Pèlerine as well as any specialist (e.g. attending physician in case of medical history) in order to validate your ability to undertake the planned trip.

Our range of trips includes accompanied or unaccompanied tours for groups or families, as well as tailor-made trips that can be devised according to your wishes at the time, with the help of one of our advisers. Our trips do not include transport to the starting point of the tour. If you wish to book your plane or train tickets with La Pèlerine, you must ask us when you register. For air tickets, you will be charged an additional fee of 20 euros per ticket.

1.1 Camino de Compostela walks

La Pèlerine offers you several options on the mythical route to Santiago de Compostela: Accompanied or Free walking, but also cycling, in a group, in the "Grand Confort" option or made-to-measure.

1.1.1. Compostela by bike

La Pèlerine offers you the opportunity to set off on the Pilgrim's Way to Santiago de Compostela by bike, on a self-guided basis. Bike hire is not included in the price of the tour but is available as an option on request.

1.1.2. Compostelle "Grand Confort"

This package allows you to set off on the Pilgrim's Way to Santiago de Compostela while enjoying accommodation in 2 or 3-star standard hotels and 4-star standard bed and breakfasts.

1.1.3. Made-to-measure Compostela

If our classic and standard stays do not meet your expectations, if the daily stages seem too short or too long, La Pèlerine offers you the "Made-to-measure Compostela" space on its Site. From Le Puy en Velay to Santiago de Compostela, you can choose your departure town, your daily pace, the number of days and personalise each stage of your journey. Nothing is imposed, you alone decide.

1.2 Accompanied tours

Accompanied tours allow you to travel in a small group with a guide who is a specialist in the chosen region.

Our tours are likely to welcome minors accompanied by an adult, provided that their age and physical ability

make it possible to complete the tour under normal conditions.

1.3. Freedom Tours

Going on a Freedom Tour in France or abroad allows you to walk alone, as a couple or with friends.

We propose an itinerary for which we book your accommodation and luggage transfers, and you receive all the documentation you need to make your trip a success.

1.4. Family walks

La Pèlerine also offers tours specially designed for families. These tours are only available to participants travelling with at least one minor child.

1.5. Cycling tours

La Pèlerine has expanded its range of cycle tours throughout France. We reserve accommodation and luggage transport between each stage. Bike hire is not included in our programmes.

1.6. Voyages en Liberté +

La Pèlerine has developed a "privilege" travel concept during which individual and personalised care allows you to travel abroad without date constraints. A personal adviser will welcome you and accompany you throughout your stay.

1.7. Group travel

If you would like to take off with friends to walk part of the Way of St James or one of the other routes proposed on the site and share in this wonderful adventure, if you have already set up your group and need help to finalise your project, we will be happy to help you make your choice, find the stages best suited to your needs and provide you with a personalised quote.

2/ INSCRIPTION AND PAYMENT

2.1 Registration

- Online registration on the Site: on the page of the tour you have chosen by clicking on "Date and Price" and then on "Book". This will take you to the registration form, where you will be asked to choose the dates of your trip, select the type of accommodation you would like and the number of participants, enter your contact details and those of the trip participants, validate the technical information sheet and our terms and conditions of sale, choose any insurance you would like to take out and, finally, select a method of payment.

You can pay your deposit of 30% of the total cost of the trip by credit card, cheque or bank transfer. If you register less than less than 30 days before departure, you must pay the full price of your trip when you register.

- Registration by post: You can register by using the booking form available at the end of the brochure or sent on request by one of our advisers by e-mail or by post and returning it to us duly completed and signed together with payment of your deposit and/or the full price of the trip depending on the date of registration to the following address: LA PELERINE 32 Place Limozin 43170 SAUGUES.

- Enrolment at an agency: If you come to our agency, you can work out your programme with one of our advisers, fill in and sign your registration form and then pay the deposit or the full price of your trip, depending on your registration date.

- Registration by telephone: You can with La Pèlerine by telephone on 04 71 74 47 40 giving the reference number of your chosen trip.

Please note that the person making the registration in the name and on behalf of all the participants in the trip

undertakes to pass on to each traveller all the information provided by La Pèlerine concerning the trip.

Your registration will only be taken into account on receipt by La Pèlerine of your registration form accompanied by payment of the price of the trip in accordance with the terms and conditions set out in article 2.2, depending on the departure date.

Our confirmation of enrolment will be sent to you within ten days (confirmation of availability from our service providers is not immediate and may take several days) by e-mail or by post; it will be accompanied by an initial file including an invoice, which will mention the date of payment of the balance (in the case of enrolment more than 30 days before departure) and the description of the holiday. These will be sent to you by e-mail if you have chosen this option on your registration form or when you register online on our Site. If the trip booked is full and/or unavailable, La Pèlerine will refund all sums paid, as soon as possible and without withholding any sums.

In accordance with article L 221-28 of the French Consumer Code, you do not benefit from a retraction period for the purchase of travel services.

2.2 Payment methods

You may pay the price of your trip (deposit then balance of the price for bookings made more than 30 days before the departure date or the total price for bookings made less than 30 days before the departure date) by bank cheque (only for payments made more than 30 days before the departure date of the trip), bank card, bank transfer, holiday vouchers, or in cash up to the limit stipulated in Article D 112-3 of the French Monetary and Financial Code (i.e. 1000 euros per booking).

The balance of the price must be paid 30 days before the departure date, without any reminder from us. Any delay in the collection of all or part of the price may be considered as a cancellation/rescission on your part, for which the cancellation charges referred to in article 5 below will be applied.

On receipt of the balance of the payment of the price by La Pèlerine, you will receive a second file containing the list of accommodation (for the Freedom packages), the topo-guide or route notes (1 copy for 4 people), the exchange vouchers (on certain Freedom hikes only), the booklet of the insurance contract(s), leaflets on certain types of accommodation, an appraisal form, luggage tags (Freedom option only).

2.3 Invoice

For all payments validated and cashed by La Pèlerine, an invoice will be sent to the person signing the registration form within 15 days of cashing.

3/ VOYAGE INFORMATIONS

3.1 Administrative and health formalities

Before registering to embark on your journey, you must check that each traveller, depending on their personal situation and nationality, is in possession of a valid passport or national identity card (CNI), the document which will be used to carry out the planned journey, as well as any other document(s)/ supporting documents (visa/authorisation to leave the country, family record book, etc.) necessary and in compliance with the requirements for transiting and/or entering the country(ies) of the journey.

La Pèlerine provides information on formalities for all French nationals. For other nationalities, we are at your disposal to help you with the formalities.

In order to organise your trip, we would like to inform you that certain countries and/or service providers (in particular, customs authorities, airlines, etc.) require the transmission of some of your personal data in order to complete forms and/or requirements relating to their reservation and/or control systems. To this end, we may be obliged to communicate the following data to these service providers:

your surname, first name(s), date of birth and gender as they appear on the passport or identity card (if the destination permits) that you will use for your trip and to complete transit or entry authorisations (visa, ESTA, etc.), data relating to a need for assistance (children, pregnant women, people with reduced mobility) or other.

It is important to point out that if you need to fill in any administrative forms yourself to complete your journey, you must fill them in with the same information as that sent to La Pèlerine, i.e. surname, first name(s), date of birth and gender. If you fail to comply with this procedure, you may be refused entry to the country (transit or final destination).

A traveller who is unable to use the transport tickets made available to him/her due to failure to present the required police, customs and/or health documents may not claim any refund of the price of his/her journey. La Pèlerine cannot, under any circumstances, be held responsible for the consequences of the traveller's failure to comply with police, customs or health regulations prior to or during the journey.

3.2 Information on safety and health risks

Before your departure, La Pèlerine advises you to regularly consult the "country information" relating to the country or countries you are travelling to on the French website of the Ministry of Europe and Foreign Affairs (MEAE): www.diplomatie.gouv.fr, "Conseils aux voyageurs" section.

As part of its duty to provide information, La Pèlerine may ask you to sign the MEAE form for the country(ies) you are visiting or travelling through. This request does not constitute a waiver of liability.

La Pèlerine also recommends that you regularly consult the information on the risks of the country(ies) you are travelling through and the recommendations available on the websites https://solidarites-sante.gouv.fr/ (French Ministry of Solidarity and Health) and www.who.int/fr/ (World Health Organisation).

3.3. Accessibility

Our tours require a greater or lesser degree of physical involvement depending on the level of fitness required and are therefore not adaptable and/or accessible to everyone.

We invite you to contact us for further information on the accessibility of our trips and for any requests for assistance, particularly at the airport and/or during the journey.

3.4. Minors

Registration requests from minors under the age of 18 who wish to undertake a trip unaccompanied by their parents or guardians, subject to the prior agreement of La Pèlerine, must be signed by the father, mother or legal guardian and bear the words "agreement of the father, mother or guardian".

Since 15 January 2017, it has been compulsory for all French minors travelling abroad without at least one of their parents or legal guardians to obtain authorisation to leave the country. Minors travelling without at least one of their parents or legal guardians must present the following three documents:

- The minor's identity document: national identity card or passport, depending on the requirements of the destination country.

- Authorisation to leave the country form, signed by one of the parents with parental authority (information available on the www.service-public.fr website).

- Photocopy of the identity document of the parent signing. Please note that authorisation to leave the country applies to all minors travelling without at least one of their parents, whether or not they have a passport. For minors travelling with a parent, guardian

or other adult, it is the responsibility of the latter to ensure that they are in possession of the necessary documents (family record book and national identity card or passport and, where applicable, authorisation to leave the country). In any event, travellers under the age of 18 must also carry details (name, address and telephone number) of their parents or legal guardians at all times during the trip, so that they can establish direct contact with them.

4/MODIFICATIONS / I NTERRUPTIO N OF SERVICES REQUESTED BY THE TRAVELLER

4.1. Transport services

After registration for the trip, any change to the ticket and in particular to the surname(s)/first name(s) of the traveller(s) may result in additional costs and/or penalties, the amount of which must be paid by the traveller(s) to La Pèlerine before departure.

4.2. Other services

A handling fee (€50) will be deducted for any change to the reservation already made (type of room, departure date, change of destination, etc.). Any reservations for additional nights at the beginning or end of the trip must be made at the time of booking and specified on the booking form. For organisational reasons, once the trip has begun, you must follow the programme as confirmed. It will no longer be possible to change your accommodation or the order of the stages.

4.3. Tour dates

Any request to change the departure and/or return date, once accepted by La Pèlerine, may give rise to the invoicing of additional costs imposed by our service providers, which will be passed on to you.

4.4 Transfer of the contract

In accordance with article R 211-7 of the French Tourism Code, you have the option of transferring your contract to a transferee (purchaser) who fulfils the same conditions as you to make the journey, as long as the contract has not produced any effect. You are obliged to inform La Pèlerine of your decision by any written means that allows an acknowledgement of receipt to be obtained and no later than seven days before the start of the journey. In the event of the transfer of a contract, the transferor and/or the transferee must first pay the costs incurred by the transfer, which will be communicated to you by your advisor.

5/ CONDITIONS AND ANNULATION FEES / RESOLUTION

5.1. Cancellation/rescission by the traveller

If you find yourself obliged to cancel your trip before it begins (departure date), you must inform La Pèlerine and the insurer by any written means that allows you to obtain an acknowledgement of receipt, as soon as the event giving rise to this cancellation occurs. The date of issue of the written notice will be taken as the date of cancellation for the purposes of invoicing cancellation costs. On the basis of the documents you provide, the insurance company will assess the date of the event giving rise to your decision to cancel the trip in order to reimburse you for the cancellation costs. Neither La Pèlerine nor the insurer will reimburse the insurance premium, the visa fee or the cost of sending the passport.

In the event of cancellation of your trip, the following cancellation/resolution fees will be charged:

1) more than 31 days before departure: 15% of the cost of the trip.

2) between 30 days and 21 days before departure: 30% of the cost of the trip.

3) between 20 days and 14 days before departure: 55% of the cost of the trip.

4) between 13 days and the day of departure: 75% of the cost of the trip.

If the person with whom you are sharing a room cancels, you will be charged the single room supplement.

When several travellers are registered on the same registration form and one of them cancels their trip, cancellation fees will be deducted from the sums collected by La Pèlerine, regardless of who made the payment. In the event of cancellation, for any reason whatsoever, costs outside of the trip booked with La Pèlerine and incurred by the traveller(s) such as traveller(s) such as transport costs to the place of departure of the trip and return home, costs of obtaining visas, travel documents, vaccination costs, will not be reimbursed in any way.

5.2. Cancellation by La Pèlerine due to an insufficient number of participants

We may exceptionally be forced to cancel a departure if the minimum number of participants required for the trip is not reached. You will be informed of this decision no later than :

- 20 days before the start of the trip or holiday in the case of trips lasting more than 6 days;

- 7 days before the start of the trip or holiday in the case of trips lasting between 2 and 6 days;

- 48 hours before the start of the trip or holiday for trips lasting no more than 2 days. You may be offered an alternative solution. If the proposed alternatives do not suit you, your payments will be refunded in full, without further compensation. All costs incurred by you remain your responsibility (purchase of transport tickets, accommodation, equipment required for the trip).

6/ INSURANCE

Our insurance policies, Contrat Tranquillité Carte Bancaire and Contrat Tranquillité, are individual and optional. It is your responsibility, before or during your trip, to personally contact the insurer who covers you for your trip in order to activate the insurance. The insurance premium, visa fees and registration fees are not refundable by either La Pèlerine or the insurer. To find out the exact contractual terms and conditions, in particular the scope of cover, excesses and exclusions, we recommend that you carefully read the full contractual terms and conditions as well as the product information documents available on request from La Pèlerine or on the website www.lapelerine.com under the heading "Conditions of Sale".

"Terms and Conditions". A copy of the contract, detailing the cover taken out and the procedure to follow, will be sent to you at the same time as confirmation of your enrolment, or on request.

The Tranquillity Contract (Assistance/Repatriation insurance, cancellation and interruption of stay insurance) is invoiced at 4.15% of the total price of the trip.

The Contrat Tranquilité CB (cover and limits are in addition to those of your Visa Premier, Infinite, Master Card Gold, Platinium card, after refusal of the latter) is invoiced at 3.15% of the total price of the trip.

The insurance offered must be taken out at the time of registration or within 48 hours of registering for the trip.

Procedure for declaring and processing claims.

a. Request for medical assistance

In the event of cancellation of your trip or any other incident covered by the travel insurance contract taken out (plane delay, loss of luggage etc...), we invite you to make your declaration online at the Following address: http://lapelerine.assurinco.com No-shows on the day of departure and/or unjustified withdrawals during the trip do not entitle you to any reimbursement.

If you were already covered for the same benefits by a previous insurance contract, we would like to inform you that you have a 30-day waiver period relating solely to the insurance taken out and provided that this insurance has not had any effect.

7/ TRANSPORT CONDITIONS

7.1 Identity of the carrier

If you wish to book your transport tickets with La Pèlerine, the identity of the carrier or carriers likely to provide your transport during your journey will appear on your quotation. In the event of a change occurring after your registration, La Pèlerine undertakes to inform you by any means, as soon as it becomes aware of them, of any changes in the identity of the carrier or carriers, particularly airlines. In accordance with our obligation, we inform you that the European list of banned airlines can be consulted on the website http://ec.europa.eu/transport/modes/air/safety/airban_fr

7.2. Changes to transport timetables

For air transport, we inform you that flight times may vary up to the start of the journey, depending on the traffic authorisations given to the companies by the competent authorities. To avoid any risk of confusion, we will send you the timetables as soon as they are confirmed by the airline.

Stopover times are determined by the airlines according to their flight plans and may be modified, without this constituting grounds for cancellation without charge.

Any flight may take place at any time on the scheduled day and may involve arriving at the airport a few hours before the start of that day and no more than 3 hours before.

7.3. Change of itinerary, station, port and/or airport

Any carrier may be required to modify without notice not only the timetable but also the itinerary as well as the stations, ports and/or airports of departure and destination, notably due to technical, climatic or political incidents external to La Pèlerine or strikes external to La Pèlerine. These events may lead to delays, cancellations, or additional stopovers, changes of aircraft or routes. In the case of air transport, the traveller holding a boarding card remains under the protection and assistance of the airline company.

7.4. Non-fulfilment of the transport service

In the event that the reserved transport service is not provided by the passenger, for any reason beyond La Pèlerine's control, the outward and/or return transport ticket will be cancelled by the carrier. The passenger will then have to purchase one or more tickets at his/her own expense in order to be able to make the journey. For air tickets, boarding taxes for unused tickets will be refunded on request (art L 224-66 C. consom.).

7.5. Delay / Cancellation of transport services

In the event of a delay in transport on departure or return from the trip, denied boarding, and/or cancellation of the flight by the airline, we recommend that the traveller, to enable him/her to keep all original documents (tickets, boarding passes or baggage tickets, etc.) and to ask the carrier for any written proof.

In the event that the participant(s) decide(s) to cancel the trip due to the occurrence of the above-mentioned changes, even though they do not affect one of the essential elements of the trip, they will be invoiced the cancellation costs referred to in article 5.1 above.

7.6. Luggage

The airline is solely responsible for damage, theft, loss or delay of baggage entrusted to it. You must report the damage to the airline at the airline counter at the

airport and in writing as soon as possible. International agreements define the time limits for making a complaint and the compensation payable by the air carrier in the event of late delivery or damage to baggage.

All passengers are responsible for keeping their fragile and valuable personal belongings with them at all times (glasses, electronic equipment, documents, etc.) and must ensure that their baggage is present when transfers are organised.

8/ ACHEMINEMENT BEFORE DEPARTURE AND ON RETURN FROM THE TOUR

For all travellers who organise their own services before departure (transport, accommodation, etc.) to the place where the journey begins and to their home on return from the journey, La Pèlerine recommends that they purchase services (tickets and other services, etc.) that can be modified and/or reimbursed and that they allow reasonable transfer times between airports/ports/stations.

In the event of an unforeseeable or unavoidable event caused by a third party or by the traveller, which would modify the travel services subscribed to with La Pèlerine and/or would imply the modification of the services reserved by the traveller(s) (not included in your trip), La Pèlerine shall not be held to reimburse the costs incurred.

9/ FINANCIAL MODALITIES

9.1. Prices

The prices applicable on the day of registration are those accessible on the Site for a holiday or those of a valid quote for any other personalised trip including or not including a holiday. They apply from the pick-up point for the start of the trip to the drop-off point on the last day of the trip. The services included and not included during the holiday are specified in the technical data sheets, available at any time on the Site or on request.

9.2 Registration fees

For all registrations, a fee of 15 euros per participant will be charged. The reservation of transport tickets by La Pèlerine, which are not included in our tours, will result in the invoicing of an additional fee of 20 euros per ticket.

9.3. Delivery costs abroad

For all customer registrations outside France, a foreign delivery charge of 20 euros will be invoiced. This surcharge is in addition to the usual registration fees set out in article 9.2.

9.4. Priority processing fee for registrations J-15

For all registrations with 15 days to go before your departure date, a priority processing fee of 45 euros will be charged. This surcharge is in addition to the usual enrolment fees set out in article 9.2 and to the costs of sending enrolments abroad for customers outside France set out in article 9.3.

9.5. Price revision terms

In accordance with regulations, up to 20 days before departure, La Pèlerine may adjust prices upwards or downwards, provided that they are not significant, without the possibility of cancellation/resolution at no cost to you, to take account of variations:

- The price of passenger transport resulting from the cost of fuel or other sources of energy;

- The level of taxes or charges on travel services included in the contract, imposed by a third party not directly involved in the performance of the contract, including tourist taxes, landing or embarkation and disembarkation taxes or embarkation and disembarkation taxes at ports and airports; or

- Exchange rates relevant to the contract: The variation in the cost of foreign currency will only apply to the

amount of foreign currency included in the calculation of the price of the trip.

La Pèlerine will then invoice the full cost of the additional to the traveller(s). Refusal to pay this price adjustment will be considered as a cancellation/resolution on the part of the traveller(s) for which article 5.1 will be applied.

10/ RESPONSABILITY

10.1. Civil liability insurance

In accordance with the regulations of the profession, La Pèlerine is insured for professional civil liability with MMA 14 Boulevard Marie et Alexandre Oyon 72030 Le Mans Cedex 9 - Contract n°146 161 560.

10.2. Risks incurred

Each traveller is aware that he/she may run certain risks inherent in trekking and due, in particular, to the distance from medical centres. They assume these risks with full knowledge of the facts and undertake not to hold La Pèlerine and its various service providers responsible for any accidents that may occur as a result of these risks. This also applies to the beneficiaries and any member of the family of any traveller. La Pèlerine cannot be held responsible for an accident due to individual carelessness, a personal error in the itinerary or a voluntary interruption during the journey (particularly for climatic reasons).

10.3 Responsibility of La Pèlerine

La Pèlerine cannot be held responsible consequences of the following events:

Loss or theft of tickets by the traveller(s).

 

Failure to present to the authorities and/or carriers (airlines, etc.) the administrative and/or health documents required to undertake the journey and/or cross borders, in accordance with the information provided by La Pèlerine.

Arrival after the scheduled time for check-in and/or boarding of any means of transport including air travel. No refund of the transport ticket will be due by La Pèlerine in this hypothesis.

Unforeseeable or unavoidable events of a third party such as: wars, political unrest, strikes external to La Pèlerine, riots external to La Pèlerine, technical or administrative incidents external to La Pèlerine, airspace congestion, bad weather, delays (including in mail forwarding services...), breakdowns, loss or theft of luggage or other personal effects of travellers.

Cancellation imposed by exceptional and unavoidable circumstances, and/or for reasons the safety of travellers, and/or by order of an administrative authority: in this event, La Pèlerine In the event that La Pèlerine's liability is called into play due to the actions of service providers, the limits of compensation provided for by international conventions will be applied, in accordance with article L 211-17-IV of the French Tourism Code. Except in the case of personal injury, the maximum financial liability of La Pèlerine will be equal to three times the total price of the trip.

We remind you that the person making the registration in the name and on behalf of all the participants in the trip undertakes to transmit to each traveller all the information provided by La Pèlerine concerning the trip so that La Pèlerine cannot be held responsible for any defect or omission in the transmission of this information.

11/ RECLAMATIONS

11.1. During the journey

We invite you to contact La Pèlerine if you notice any non-conformity in the provision of your holiday, by calling our emergency number, the contact details of which will be given to you on the documents provided by La Pèlerine. In the event of a claim, your failure to report any non-conformity in the provision of services during your trip will, where appropriate, be taken into account if it could have financial consequences.

11.2. After your trip

Any complaint must be sent to La Pèlerine, by any written means allowing an acknowledgement of receipt to be obtained as soon as possible after the return date, accompanied by supporting documents, to the following address: La Pèlerine - Service Relations Clients, La Pèlerine 32 Place Limozin 43170 SAUGUES. In the absence of a satisfactory response within 60 days, we inform you that you may refer the matter to the Tourism and Travel Ombudsman, whose contact details are as follows: MTV Médiation Tourisme Voyage - BP 80 303 - 75823 Paris Cedex 17. 12/ USE AND PROTECTION OF PERSONAL DATA

The information that you send us is recorded in a computerised file by La Pèlerine, a company registered in the Trade and Companies Register of Le Puy en Velay (43) under number 439 482 233 and whose registered office is located at 32 Place Limozin in SAUGUES (43170), in its capacity as data controller. Certain information must be provided to La Pèlerine at the time of your request with a view to subscribing to a trip and then carrying it out; this information is indicated visibly by an asterisk. 13/ TRAVELLER'S RIGHTS

The combination of travel services offered to you is a package within the meaning of Directive (EU) 2015/2302 and article L.211-2 II of the French Tourism Code.

You will therefore benefit from all the rights granted by the European Union applicable to packages, as transposed in the Tourism Code.

La Pèlerine will be entirely responsible for the proper execution of the package as a whole.

In addition, as required by law, La Pèlerine has protection to refund your payments and, if transport is included in the package, to ensure your repatriation in the event that it becomes insolvent.

Essential rights under Directive (EU)

2015/2302 transposed into the Tourism Code:

Travellers will receive all essential information about the package before concluding the package travel contract.

The organiser as well as the retailer are responsible for the proper execution of all travel services included in the contract.

Travellers are provided with an emergency telephone number or contact details to enable them to contact the organizer or retailer.

Travellers may transfer their package to another person, giving reasonable notice and possibly subject to additional charges.

The price of the package may only be increased if specific costs increase (e.g. fuel prices) and if this possibility is explicitly provided for in the contract, and in any case may not be changed less than twenty days before the start of the package. If the price increase exceeds 8 of the package price, the traveller may cancel the contract. If the organiser reserves the right to increase the price, the traveller is entitled to a price reduction in the event of a reduction in the corresponding costs.

Travellers may cancel the contract without paying any cancellation fees and receive a full refund of payments made if any of the essential elements of the package, other than the price, undergoes a significant change. If, before the start of the package, the professional responsible for the package cancels it, travellers may obtain a refund and compensation, if applicable. Travellers may cancel the contract without paying a cancellation fee before the start of the package in the event of exceptional circumstances, for example if there are serious safety problems at the destination that are likely to affect the package.

In addition, travellers may cancel the contract at any time before the start of the package, subject to payment of an appropriate and justifiable cancellation fee.

If, after the start of the package, important elements of the package cannot be provided as planned, appropriate alternative services must be offered to travellers at no extra charge. Travellers may cancel the contract without paying cancellation fees if the services are not performed in accordance with the contract, if this significantly disrupts the execution of the package and if the organiser does not remedy the problem. Travellers are also entitled to a price reduction and/or compensation in the event of non-performance or poor performance of travel services. The organiser or retailer must provide assistance if the traveller is in difficulty.

If the organiser or retailer becomes insolvent the amounts paid will be refunded. If the organiser or

retailer becomes insolvent after the start of the package and if transport is included in the package, the repatriation of the travelers is guaranteed.
